What should I check when I start my first job?

Your first job should come with a written appointment letter, probation of six months at most, at least the minimum wage and SSF from day one.

Short answer

Ask for a written appointment letter or employment contract before you start. It's required by law, and employers who don't give one can be fined. Check that your basic pay is at least the minimum wage, that probation is no longer than six months and that your employer will register you with the Social Security Fund from your first day. Get a PAN for tax and keep your payslips. Overtime, leave and the festival allowance are your rights from the start, not perks.

Common problems

My employer won't give me an appointment letter.

The Labour Act lets the authorities order an employer to issue one and fine it up to Rs 10,000 per worker. Without one, it's harder to prove your job and pay later.

Can probation be extended beyond six months?

No. The Act allows up to six months. If you aren't let go during probation, you become a regular employee automatically.

Do trainees and interns have rights?

Trainees are owed at least the minimum wage and the same social security benefits, including sick leave, gratuity and provident fund. If the same employer then hires you, there's no new probation.

What documents will I need?

Usually your citizenship, academic certificates, photos, a PAN and a bank account for salary. Employers often ask to see original certificates at interview.
