How much leave do I get, and how many hours can I be made to work?

Nepal's Labour Act sets 8 hours a day, overtime at 1.5 times pay and paid home, sick, maternity, paternity and mourning leave. The full list.

Short answer

Under the Labour Act 2074 you can't be made to work more than 8 hours a day or 48 hours a week, with half an hour's rest after five hours. Overtime is limited to 4 hours a day and 24 a week and paid at 1.5 times your basic pay. You earn one day of paid home leave for every 20 days worked and get 12 days of paid sick leave a year, 13 paid public holidays (14 for women), 98 days of maternity leave with 60 paid, 15 days of paid leave when your wife gives birth and 13 days of paid mourning leave.

Workers also get a festival allowance of one month's basic pay each year.

Common problems

Can my employer refuse my leave?

Sick leave, mourning leave and maternity leave are rights you can claim. For other leave, your employer can refuse, delay or change the dates for work reasons, but has to give the reason.

What happens to leave I don't use?

You can save up to 90 days of home leave and 45 days of sick leave. When you leave the job, you're paid for the saved leave at your last basic pay.

Do I need a doctor's note?

Only if you take more than three days of sick leave in a row.

I worked on a public holiday.

If your work can't stop, you should get substitute leave within 21 days. Work done without substitute leave counts as overtime.

Does this apply to me?

It covers most private sector workers. Civil servants, the army, police and some others are under separate laws.
