Abortion is legal in Nepal up to 12 weeks on request and up to 28 weeks in set situations, at licensed facilities. The law and where to go.

Short answer

Yes. Under the Right to Safe Motherhood and Reproductive Health Act 2075, a woman can have a safe abortion up to 12 weeks of pregnancy with her own consent. Up to 28 weeks it's allowed if a doctor finds a risk to her life or health or of a disabled baby, if the pregnancy is from rape or incest, if she has HIV or another incurable disease or if the foetus has serious defects. It must be done by a licensed health worker at a licensed facility. Choosing an abortion because of the baby's sex is banned.

Look for a facility that's licensed for safe abortion services. Government hospitals and many health posts are.

Common problems

Do I need my husband's or family's permission?

No. For an adult woman the consent that counts is hers. For someone under 18, or who can't give consent, the guardian consents, but the service must be given in the girl's best interests.

Is it confidential?

Yes. The Act requires licensed facilities and health workers to keep all records and information about your reproductive health confidential.

Is it free?

Government facilities provide it free and are reimbursed by the government, according to research by CREHPA. Private and NGO clinics can charge within limits set by the federal government.

Can I buy abortion pills from a pharmacy?

Use a licensed provider, even for medical abortion with pills, so the pregnancy's length and your health are checked and you get follow-up care. Abortion outside the Act's conditions is still a crime.

Can anyone force me to have an abortion?

No. Forcing, threatening or enticing a woman into an abortion is illegal.
